1. All bookings are subject to availability and are only confirmed once a deposit or full payment has been received.

2. We will only use your contact details (name, email address and phone number) for the purposes of booking an activity at Tile Farm Off Road for you. Your information will not be passed onto a third party (with the exception of Quads and Clays booking where information may be shared with our partners Aim For The Sky). By sending us a booking request or contact form you are agreeing to providing us your contact details for these purposes.

 

ACTIVITY terms and conditions

BOOKING PROCESS

Bookings can be initiated by completing a booking form via our website or by telephone call. A response will be given by email or telephone giving availability. All bookings require either full payment or a deposit at the time of booking to reserve the date and time requested. The type of payment required is clarified at the time of booking. No bookings are confirmed until a deposit or full payment has been received.

BOOKING CONFIRMATION

When the required payment of a deposit or the full payment has been received, you will receive a booking confirmation providing full details of the activity you have purchased. Full details of the venue address will be provided on the booking confirmation. If you have not received your booking confirmation, or the details on the confirmation are incorrect, please contact Tile Farm Off Road Limited at the earliest opportunity before the day of your planned activity via email to contact@tilefarmoffroad.com or phone to 01244 300321 (option 3).

YOUR ACTIVITY

All of our activities are detailed on our website with as much information as possible. The time specified is approximate and is a total time for the activity session. Times may include any safety briefings and instructions required to partake in the activity. Please familiarise yourself with the details and requirements of each activity before booking and if in doubt please contact us to discuss before you book in.

Prices and details of activities may change from time to time. The price and activity details are correct at the time of booking.

Please take note of arrival times as specified on your booking confirmation as it is often prior to the time your activity is due to start.

ARRIVAL TIMES

Please take note of the required arrival time prior to the specified time of your activity to ensure you do not miss out on your activity. For most activities this is at least 20 minutes before your booking time to allow for your safety briefing and kit out where applicable however please refer to your booking confirmation to confirm the time you are required to arrive.

No participant can take part in the activity without the relevant safety briefing and paperwork being completed.

We cannot guarantee that late arrivals will be able to take part in their booked activity regardless of the reason for your late arrival. If permitted to still take part in your activity, late arrivals will not get the full time specified for the activity. This is at the Company’s discretion. Late arrivals are normally treated as a cancellation of the event and the cancellation policy will apply meaning any monies paid will be lost.

If a member of your group is a late arrival, the members of the group that have arrived on time will be able to take part in their activity as planned. The late arrival will be turned away and the cancellation policy applied to them.

Please plan your journey to our site prior to setting off and take into account possible traffic or diversions.

CANCELLATION POLICY

A full refund or offer of postponement can be provided if more than 7 days notice has been given to Tile Farm Off Road Limited of cancellation or reduction in numbers either by email to contact@tilefarmoffroad.com or phone call to 01244 300321 (option 3).

Any cancellation or reduction in numbers between 3-7 days will be offered a postponement of offer of 50% of your payment back.

Any cancellation or reduction in numbers with less than 48 hours notice will not be offered any option of refund or postponement.

All cancellations must be acknowledged by Tile Farm Off Road Limited in writing for them to be valid.

The above cancellation terms also apply to cancellation due to illness or infectious diseases (including Covid-19). Should you test positive for Covid-19 please do not attend for your activity.

If the decision to postpone is taken, this forfeits any option of a refund or option to postpone again.

REFUNDS

If you are eligible for a refund, this will be completed within 48 hours. It may take 2-5 days to then go back into your account. The amount refunded may be a partial or full refund dependent on the situation in line with the cancellation policy. Any bookings fees may not be refunded where applicable. The absolute maximum repayment will be equal to the monies paid by you to us and no additional payments will be made in compensation for any reason. Taking part in any activity booked will negate the ability to request a refund.

GROUP BOOKINGS

Discounted bookings for larger groups are priced on the number of participants. Any reduction in participants may result in the price per person changing to the price applicable to the amended group size if you do not meet the minimum participants required for the discounted price.

GIFT VOUCHERS

Gift vouchers can be purchased via telephone call to the office, via email, or in person. Each gift voucher is given a unique code which is required at the time of booking. Once purchased, gift vouchers hold no monetary value and can only be used as full payment or part payment of an Activity. Details of which activity they can be redeemed against will be included on the voucher. Each voucher has an expiry date which is detailed on the voucher itself. Usually vouchers are valid for 6 months but there may be exceptions. In the event of the business temporarily closing for any reason, for example a government lock down, the voucher will be extended for the duration of the lock down. Refunds cannot be provided for gift vouchers. Once past the expiry date, the voucher is void.

BAD WEATHER/ UNFORSEEN CICRUMSTANCES/ FORCE MAJEURE

We may cancel a booking if the weather is deemed unsuitable or unsafe to participate in the activity, or if any other unavoidable circumstance arises (including any government restrictions). Your booking will be rescheduled on a date that is mutually convenient within 3 months of your original booking date (unless government restrictions mean this time period needs to be extended) or a full refund will be offered.

If the decision to rebook is taken the option of a refund is no longer available.

If the participant chooses not to go ahead with the activity, but we deem it safe and appropriate to do so, then the cancellation policy will apply to them.

If the Company is unable to perform any of its obligations under this Agreement by reason of any circumstances, cause or event outside its control including (without limitation of the generality of this Clause) any governmental restrictions, adverse weather, riot, commotion, acts of God, industrial action, breakdown of plant or any failure of gas, water service, electricity etc., the Company shall be entitled to be relived of its obligations hereunder to the extent to which performance of the obligations is prevented, frustrated or suspended. The Company will use its best endeavours to reschedule the event as soon as practicably possible after such occurrence as listed. In the event that it is not possible to reschedule for any reason the circumstances of non-performance if the obligations of the Company hereunder shall not entitle the Client to claim damages of any kind whatsoever whether direct, indirect or consequential.

EXCLUSION FROM THE VENUE

Should any rider act in an unsafe, derogatory, abusive or inappropriate manner at any stage of the booking, our staff have the right to ask you to leave the site and/or refuse your participation in the activity. No refund or return will be provided if you have been asked to leave the venue due to your behaviour.

We also have the right to refuse access to the booked activity at any stage of the booking and ask you to leave site without offer of refund or return should the rider be underage, the incorrect height or weight for the activity, are unfit to take part in the activity (e.g. due to any physical or mental impairment, or believed to be under the influence of alcohol or substances), arrived too late for the activity, or considered to be a danger to themselves, or other participants/members of staff.

PARTICIPANT PERSONAL SAFETY AND HEALH REQUIREMENTS

All of our activities on site are facilitated to a high safety standard however due to the nature of the activities there is an inherent risk of physical danger throughout. Participants and visitors to site must take seriously any safety advice, signage and requirements during their visit. If you are ever unsure of anything prior or during your visit, please do not hesitate to ask a member of staff.

Adequate safety equipment and attire must be worn for the duration of your activity. Refusal to wear the correct safety equipment and attire will mean you are unable to take part in the booked activity and it will be deemed as a cancellation and the cancellation policy will apply.

Always ride within your capability and do not engage in risky or daring behaviours other than what is deemed as involved in the activity already.

All paperwork must be read and signed prior to taking part in the activity. By completing this paperwork and taking part in the activity it is given that you fully understand the risks involved and accept responsibility for your own personal safety and that of any child/charge you have responsibility for who is taking part in the activity. Any refusal to sign the disclaimer means you will be unable to take part in the activity and the booking will be considered a cancellation and the cancellation policy will apply,

If you are in doubt of the suitability of the activity for you or your child/charge, physically or mentally, please speak to a member of staff at the earliest opportunity. Please consult your medical health professional prior to booking if you have any doubts the activity is suitable for you or if you have a pre-existing medical need.

We regret to inform that some health needs are unfortunately not covered by our insurance where a person’s ability to operate any equipment needed for the activity may be compromised. This is because it could make the activity unsafe for the participant or others taking part in the activity. Please discuss with us any relevant health needs prior to booking so we can accommodate you where possible.

ACTIVITY RESTRICTIONS

Please take note of the restrictions for each activity detailed on the website. This relates to minimum age, weight/height restrictions, and physical and mental fitness to take part in the activity. No responsibility can be taken by Tile Farm Off Road Limited should you book for an activity unsuitable for you where the information is available on our website. If in doubt, please contact us before booking in as the cancellation policy applies for any riders unable to participate in the activity on the day.

DRIVING LICENCE

You are not required to have a driving licence for any of our activities.

COMPLIMENTS AND COMPLAINTS

If you are not satisfied with your experience, or have any complaint about the any aspect of your visit, please verbalise this on the day of your visit to a member of staff so we can resolve any issues raised. If it is not possible to verbalise this on the day or a member of the management team is not available to help resolve the issue, please put your complaint in writing to us within 48 hours and either send it via email to contact@tilefarmoffroad.com or via post to Tile Farm Off Road, Tile Farm, Wicker Lane, Guilden Sutton, Chester. CH3 7EL. We endeavour to respond back to you within 7 working days. If no complaint is shared on the day or sent to us within 48 hours after the experience it is deemed that you found the experience acceptable.

If you feel you would like to compliment any member of staff or the experience you received we would welcome this verbally on the day or via writing to us on the details provided above.

STAFF AND VENUE SAFETY

For the purposes of staff and venue safety CCTV and body worn cameras are in operation. The footage from these cameras is not shared outside of the company unless express permission is given by those recorded unless it is for criminal or insurance investigation purposes. If you are unhappy with cameras being used on site then please do not book in.

If you wish to take your own recordings or photographs of your experience then you are welcome to do this, please discuss with a member of staff who will be able to help you.

OUR TERMS/ SEVERABILITY

All bookings will be subject to these same terms and conditions without exception. All customers will have deemed to have made themselves aware of these Terms & Conditions and will have accepted them in their entirety and without exception as part of their booking with us. No verbal or other communication overrides these terms and conditions in any respect whatsoever.

All of the provisions, clauses and paragraphs in these Terms and Conditions should be read and construed independently of each other. If any provision, clause or paragraph in these Terms of Business is held to be invalid or unenforceable such provision, clause or paragraph will be struck out and the remaining provisions, clauses and paragraphs will remain in force.

STATUTORY RIGHTS

Your statutory rights are not affected.

JURISDICTION

These Terms and Conditions are subject to the laws of England, Scotland and Wales and you agree to submit to the jurisdiction of the courts in area in which you are domiciled.

WAIVER

Failure by this Company to enforce any of its rights under these Terms of Business is not to be regarded as a waiver of those rights unless the waiver is confirmed in writing. If this Company decides to waive any of its rights under these Terms of Business, this will not inhibit this Company from enforcing those rights at any or all times in the future.
